However, when one is arrested, and refuses to respond, any subsequent jury (should the CPS believe that there is sufficient evidence to proceed to trial), is entitled to infer what it will from silence.<BR/><BR/>If the questions have never been asked, of course, there is nothing to draw an inference from (ie, there were no question, so no silence). I'm not saying that the MHRA deliberately didn't make arrests for this reason, just for the sake of clarity. Nevertheless, it is one benefit (to GSK), of not making arrests and engaging in formal interrogation.<BR/><BR/>Matt<BR/><BR/>PS BTW, I'm guessing that the "originating competent authority" (viz: Q3), would be the MHRA (I'm not sure how accurate the use of the word "competent" is, in this instant).
