Dear MHRA,
Many thanks for the answers you gave. It would seem that your answer for question 4 is slightly inaccurate. You claim 'that every suspect has a right to remain silent'. Surely this right only applies once an arrest has taken place? I think you will find that once the words “You do not have to say anything. But it may harm your defence if you do not mention when questioned something which you later rely on in court. Anything you do say may be given in evidence” are uttered, it then becomes the suspects right to remain silent. The MHRA enforcement team never arrested any suspects therefore they had no rights.
A suspect only becomes a suspect if you are suspicious of him/her. One who is suspected, especially of having committed a crime.
Under the Freedom of Information Act - I would like to ask the following questions.
1. Whom were the suspects you refer to in the email you sent me (RE: FOI Request 08/091) on 08 April 2008 10:55?
2. As you are aware both Dr Ian Hudson and Sir Alasdair Breckenridge were previous employees of GlaxoSmithKline. Both now are part of the MHRA. Was either Dr Ian Hudson or Sir Alasdair Breckenridge interviewed by the MHRA Enforcement Officers? Remember Dr Ian Hudson has gone on record stating: “having had significant involvement with Paroxetine until 2001".
Were they questioned under caution? Did they decline to be interviewed under caution?
If they wasn't interviewed, could you please tell me why?
